CHAPTER XIV. TRAFFICCHAPTER XIV. TRAFFIC\ARTICLE 4. GOLF CARTS, POCKET BIKES AND MOTORIZED SCOOTERS

Except as provided herein, golf carts may not be operated upon public streets, roads, and alleys within the corporate limits of Moundridge, Kansas

(a)   Golf cart shall have the meaning prescribed to such word or phrase in Article 1 to the “Standard Traffic Ordinance for Kansas Cities” as prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, as adopted by the governing body.

(b)   Pocket bike shall be defined as every device having two tandem wheels, or three wheels, which may be propelled by a gasoline engine and which the headlights are lower than 24 inches, its tailpipe is lower than 15 inches, and no vehicle identification number is located on the vehicle nor can ownership of the vehicle be registered.

(c)   Motorized scooter shall be defined as a vehicle consisting of a footboard between two small end wheels, controlled by an upright steering handle attached to the front wheel, propelled by an electric or gasoline motor.

Operation of golf carts on the streets, roads, and alleys within the corporate limits of the City of Moundridge are subject to the following terms and conditions:

(a)   Golf carts may be operated on the streets, roads, and alleys within the corporate limits, except they may not be operated on any other street or roadway having a speed limit in excess of 30 miles per hour; however, golf carts may cross the above-stated streets.

(b)   Golf carts shall only be operated on the streets, roads, and alleys of the City during the hours between sunrise and sunset. Golf carts must be equipped with:

(1)   Lights as required by law for motorcycles; and

(2)   A properly mounted slow-moving vehicle emblem as required by K.S.A. 8-1717, and amendments thereto.

(c)   Every golf cart shall be equipped with sufficient brakes, head lights, tail and brake lights, turn signal equipment, and rearview mirror.

(d)   Every operator of a golf cart shall have on their person proof of liability insurance in accordance with the Standard Traffic Ordinance for Kansas Cities then in effect, and amendments thereto, and the Kansas Automobile Injury Reparations Act, K.S.A. 40-3101 et seq., and amendments thereto.

(e)   The operator of the golf cart must have in his/hers possession during operation a valid Kansas driver's license.

(f)   No golf cart shall carry more than two (2) occupants per bench seat and in any event no more than four (4) passengers, including the driver. Further, the operator shall not carry any person nor shall any person ride in a position that will interfere with the operation of the golf cart.

(g)   A golf cart shall not be operated nor parked upon any sidewalk within the City.

Every person operating a golf cart on the streets, roads, and alleys of the City shall be subject to all laws, rules, and regulations governing the operation of motor vehicles within the City, and all restrictions on the operation of golf carts as set forth in this article. Should any conflict exist between the laws regulating motor vehicles and the specific requirements of golf carts as set forth herein, the terms of this article shall prevail.

The operation pocket bikes, and motorized scooters on the streets, roads, and alleys within the corporate limits of the City of Moundridge is prohibited.

A violation of this article shall be deemed a traffic infraction. Upon an entry or plea of guilty or no contest, or upon being found guilty of a violation hereof, the penalty imposed shall be in accordance with the penalty section of the Standard Traffic Ordinance then in effect for the City.
